| The following must apply to all transactions involving the granting of a reproduction license for any of my images, and a placing of an order is deemed to be agreement to these terms. 1. All images are copyright Roger G Howard Photography. 2 A VAT invoice will be supplied to you detailing the use rights that have been purchased for each image. 3. No release or consents for any part of any image are available unless my sale invoice clearly states that a release or consent does exist. 4. Scanning by you or your agents for storage purposes is prohibited without prior written consent. 5. Only the use agreed on the invoice or pro-forma is permitted, any other use will constitute a serious breach of copyright. Publications are regularly checked to identify illegal uses of pictures. 6. The photographer has no control over, and implies no agreement to, the use or context that any picture might be put to. In particular he has no control over any text or caption that might be associated with the Photographers image. The client agrees to indemnify Roger G Howard Photography from any legal action which results from the use of any image by the client. 7. Whilst every care is taken in providing captions with the images, no warranty is given for their accuracy. 8. Either a paper or electronic copy of the final "as published" image is to be forwarded to Roger G Howard Photography within 2 weeks of publication at no cost to RGH. Each and every RGH picture use will show the credit "www.rogerghoward.com" 9. Where transparencies are supplied on loan these will always be originals. Whether a use results or not, the prospective buyer must accept responsibility for loss or damage by any cause from the moment of receipt until return to this office. It is therefore imperative that a track-back mail service is used for return. You are also advised to have adequate insurance to meet any loss or damage fees, which are currently £400.00 + VAT per image. 10. Original transparencies must be returned within 3 weeks from the date of dispatch. Transparencies not returned within this period are subject to a Rental Surcharge of £10 sterling per day per image. 11. Use of any image will indicate unconditional agreement in full to these terms, which in the event of any dispute, will be governed by English Law. 12.
